What’s involved in a “compliance check”?
  1. Agency signage
  2. Licenses (Class 1 and Class 2) and Certificates of Registration
  3. CPD certifications
  4. Randomised check of both Sales and PM files
  5. Review of the Supervision Guidelines,
  6. Review of the Policy & Procedures Manuals, and
  7. Check the Training Plans for all staff

Going through this process will help enhance the agency’s compliance, which is important for good business practice. It will also show the Licensee-in-Charge is meeting the supervision obligations.

The designated Licensee-in-Charge has overall responsibility for the supervision of the place/s of business. NSW Fair Trading have made that clear in all their determinations since the introduction of the “reforms” in March 2020. Consequently, it is important to understand agency compliance is the sole responsibility of the Licensee-in-Charge.

The systems and processes operating in the agency must be consistent with the requirements of the Supervision Guidelines (s. 32 of the Property and Stock Agents Act, 2002). So, making sure these Guidelines are followed by everyone in the office is important. Therefore, the Agency Compliance Check is an important “risk management strategy”.

We can work through this process “virtually”, or an ‘in person’ visit can be arranged. Additional costs are involved to cover travel and accommodation, if required.
